the following are the major points taken from the draft of the settlement document. alot of it is taken from the evaluators recommendations. some things were added by my attorney. for example the line about sarah moving to a better school district. this was added so that if she tries to move, shell basically have to explain to a judge why her move reflects a "better" school district.

Mother shall have sole legal custody, however, before making any major decisions regarding the child�s education, non-emergency health care, religious training or residence Mother shall consult with Father in advance (when time is available) and shall provide Father a legitimate opportunity to provide input before making the final decision.

Both parents are authorized to make emergency decisions affecting the health and safety of the child.

For a period of 90 days (beginning 10/13/09) Father is to have parenting time alternate weekends from Thursday after school until Monday morning drop-off at school, and alternate Thursday overnights from after school Thursday until Friday morning drop-off at school. Father will have weekend parenting time beginning Friday the 23rd and alternating thereafter.

Thereafter Father receives an additional period of 24 hours attached to the beginning of his Thursday overnight. This schedule is to last 60 days after which Father receives an additional period of 24 hours attached to the beginning of this period.

Thereafter, Father shall have parenting time beginning 9:00 a.m. Monday and continuing until Wednesday at 9:00 a.m. every week while school is in session. Mother shall have every Wednesday at 9:00 a.m. until Friday at 9:00 a.m. while school is in session. The parties shall alternate weekends (defined as beginning 9:00 a.m. Friday and continuing to 9:00 a.m. Monday).

Parenting time shall be one week on, one week off during the summer months for each parent, beginning with the first Friday following the last day of school, and to begin with whichever parent would normally have parenting time that weekend.

During spring break the child will spend parenting time with each parent as follows: Father shall have parenting time during the break in even years and and Mother shall have the same in odd years.

The child will have parenting time every Mother�s Day with Mother and every Father�s Day with Father.

Father shall have parenting time on Memorial Day weekend every year.

In odd-numbered years, Mother shall have parenting time for the Independence Day holiday, In even-numbered years, Father shall have parenting time for the Independence Day holiday.

Mother shall have parenting time on Labor Day weekend every year.

Father shall have parenting time on Halloween in even-numbered years, Mother shall have parenting time on Halloween in odd-numbered years.

Parenting time for Thanksgiving shall begin upon the child�s release from school on the Wednesday immediately before Thanksgiving Day and end Friday. The other parent is to have parenting time from Friday to Monday morning drop-off at school.

In odd-numbered years, Mother�s parenting time shall begin immediately following the child�s release from school for winter break and continue until Christmas Eve. Father�s parenting time shall begin on Christmas Eve and continue until school resumes. The schedule flips in even years.

Father shall have parenting time with the child in even-numbered years and Mother shall have parenting time with the child in odd-numbered years.

Both parents always have the right:
To inspect and receive school records and to consult with school staff concerning the child�s welfare and education;
To inspect and receive governmental agency and law enforcement records concerning the child;
To consult with any person who may provide care or treatment for the child and to inspect and receive the child�s medical, dental and psychological records;
To authorize emergency medical, dental, psychological, psychiatric or other emergency health care for the child.

The parent who has physical custody of the child immediately prior to an exchange shall be responsible for delivering the child to the other parent for the exchange.

Both parents share tax benefits.

Mother shall reimburse father $250 towards the $500 Father fronted for Conciliation services evaluation.

Mother represents she understands Fathers relationship with the child is important and Mother represents she will take all appropriate action to support relationship with child.

Mother moved to Sherwood in the summer of 2009 to be in a better school district. Father is moving to childs new school district to be close to the child and increase stability in the childs life.

The child will see a mental health therapist to address any anxiety associated with transitions. Such therapist is to be selected as available though the parties health insurance for the child. Such therapist shall be willing to speak with each parent on an individual basis. Neither parent shall speak with the therapist regarding the circumstances of the case before the therapist has met with the parties together.

as if i would have just moved to sherwood a year ago, all of this could have been avoided. ugh.
